Cluster Boat Mooring Policy
April 8, 1997 (Revised May 3 2006)

Section I -Applicability

Applicability. All property owners in Lakewinds II Cluster as defined in the Lakewinds II Cluster Bylaws.

Section II -Definitions

A. Waterfront property owner. An individual who owns property designated in the legal documents and deeds on file with the County (Parcel B, Block 3, Section 74) as waterfront property lots -namely residences on Lakewinds Drive with the following numbers: #2000, #2001, #2002, #2003, #2004, #2005, #2006, #2007, #2008, #2009, #2010, #2011, #2012, #2013, #2015, #2017, #2019, #2021, #2026, #2028, #2030, #2032, #2034, #2036 and residences of Lagoon Lane with the following numbers: #11200, #11204, #11206, #11208, #11210, #11212, and #11214.

B. Nonwaterfront property owner. An individual who owns property as designated in the legal documents and deeds on file with the County (Parcel B, Block 3, Section 74) as nonwaterfront property lots -namely residents of
Lakewinds Drive residences with the following house numbers: #2023; #2025; #2027; #2029; #2031; #2033; #2035; #2040; #2042; and #2044 and Lagoon Lane with the following house numbers: #11216; #11218; #11220; #11222; #11224; and #11226.

C. Boats. Includes the following types of watercraft: rowboat; sailboat; pontoon boat; deckboat (also commonly referred to as a dockboat, houseboat, or party boat); canoe; or paddleboat. Rubber, plastic or wooden rafts are considered to be removable "daily" boats.

Section III -General

A. Cluster property. Only property owners, guests and tenants in the Cluster may permanently, seasonally, or temporarily moor boats along any Cluster common property in accordance with this Lakewinds II Cluster Boat Mooring Policy and its successors, effective April 8, 1997.

B. Private Waterfront Property. Property owners, guests and tenants in the Cluster may not permanently, seasonally, or temporarily moor boats along private waterfront property owned by an individual Cluster member without the express permission of the affected waterfront property owner. All waterfront property owner may moor no more than two boats on the waterfront adjoining their property. The boats must be moored such that access to the lake from adjoining properties is not restricted.

C. Cluster Mooring Spaces. All Lakewinds II property owners are eligible to rent a permanent mooring space (See Section IV- Eligibility.)

D. Access. All Lakewinds II property owners have open and equal access to the common docks owned and maintained by the Cluster.

E. Launching. To prevent damage to Cluster common property, no boats requiring trailer launch may be launched from the Cluster's common property. Only boats that can be hand carried to the dock may be launched from the common property. All others must be launched from a Reston Association (RA) public launching area. For further clarification, contact a Lakewinds II Cluster Board member.

F. RA Lake Policies. All Lake Policies of the Reston Association must be adhered to at all times. A.     All boats, except pontoons, deck boats and large sailboats, must be removed from the lake from November 1 to March 31.  In order to keep a pontoon, deck boat or large sailboat on the lake from November 1 to March 31, the boat must be registered with RA.  See Section V, Paragraph C, RA Boat Licensing Requirement.

Section IV -Eligibility

A. Eligibility. All property owners who are and remain current in their Cluster dues throughout the mooring year will be eligible to rent a permanent mooring space within the Lakewinds II Cluster. Any property owner who becomes dues delinquent at any time during the year immediately forfeits eligibility to rent a mooring space until such time as the dues are paid current. if, at the point of dues-delinquency, the property owner already has a boat moored in a rental spot, the property owner will be required to remove such boat from the mooring space until the dues delinquency is remedied. If such boat is not removed, the property owner will be subject to the provisions of Section V, Paragraph I, "Illegal Mooring."

B. Availability of Mooring Spaces. If, at any time during the year, a mooring space becomes available, the space will first be made available to nonwaterfront property owners in good dues standing and with property
properly maintained in accordance with Cluster and Reston approved guidelines.

Section V -Rental Requirements

A. Rental application. All nonwaterfront owners that wish to rent a mooring space or use the canoe storage racks (for which there is no fee) and are eligible as defined above in Section IV must complete a rental application and file it with the Cluster Board. Mooring spaces are not available for portable boats, but canoe racks are available at the two cluster docks.  Each rack holds 5 canoes; these racks are available on a first-come, first-serve basis

B. Boat Mooring Season. The annual boat mooring season runs from April 1st of the year to March 31st of the following year, coincident with that of the RA. There are 9 mooring spaces near the cove dock and 4 adjacent to the Lakewinds Drive dock.

C. RA Boat Licensing Requirement. If a boat is to be moored the entire year, the RA requires the completion of an RA licensing agreement (for which the cost, payable to the RA, is $.30 per square foot (length times the width). RA issues a yearly license sticker that must be displayed, and in the case of pontoon boats must be displayed next to the boat's state licensing sticker.  RA annual bill for the succeeding year is sent to each boat owner in November.

D. Lakewinds II Boat Licensing Requirement: Lakewinds II will grant mooring rights on Parcel B bulkhead only to Lakewinds members who are in full compliance with RA.  This is a separate requirement from paying the cluster rental fee and is between the property owner and RA.  Each year, upon request from the Lakewinds II board, RA will provide the board a list of the Lakewinds members who are in compliance.   The board will inform RA of boats that are not in compliance; e.g., if an owner puts an unlicensed boat on the lake after RA has sent its annual billing.   If necessary, the Cluster Board will begin boat removal procedures for any unlicensed boat moored on cluster bulkhead.  All members, waterfront and nonwaterfront, must comply with RA licensing rules.  In particular, portable boats must be removed from the lake between November 1 and March 31.  RA will begin boat removal procedures for any Lakewinds member not in compliance with RA policies. 

E. Rental Fee. The Lakewinds II Cluster mooring space rental fee is $60 per year.  Bills will be sent to members in April of each year at the beginning of the boating season. Termination of the rental agreement must be done in writing and a pro-rata portion of the fee will be refunded provided that the circumstances of termination are not for cause, as determined by the
Cluster Board.

F. Maintenance Requirements. Any boat moored in a rented space or canoe stored in the canoe storage racks must be maintained in good condition. The Cluster Board, at its sole discretion, may determine what constitutes "good condition."

G. Public Nuisance. Any boat that becomes a public nuisance is subject to removal from the mooring spaces canoe racks and/or Parcel B areas by RA at the request of the Cluster Board.  The Cluster Board is not required to notify the boat owner in advance of such removal. The Cluster Board at its sole discretion may determine what constitutes a "public nuisance".  RA sends a letter to the owner stating their boat is not in compliance, whether by reason of being unlicensed, a safety risk or in disrepair.

H. Damage, Loss or Theft. Any damage, loss or theft of boats in the mooring spaces or from the canoe storage racks is solely the responsibility of the boat or canoe owner. The Cluster Board recommends that all boats moored at the rental spaces or stored on the canoe rack be locked to the mounted hardware.

I. Illegal Mooring. Anyone who moors a boat in a mooring space without renting said space is subject to a $100 fine payable to the Lakewinds II Cluster. All costs including legal fees incurred to remove the boat will also be the responsibility of the violator.

Section VI -Mooring Spaces and Requirements

A. Mooring Spaces. Designated "mooring spaces" are available in the cove and adjacent to the Cluster dock between 2000 and 2001 Lakewinds Drive. Canoe storage racks are located adjacent to the cove dock and to Lakewinds Drive dock.

B. Mooring Method. The Cluster Board has the sole right to determine how each boat must be moored (i.e., by its length or width) depending on the demand for spaces at any time. The Board will make every effort to
accommodate boat owners' wishes in order to minimize damage from lake and wind action.  There are 9 mooring spaces adjacent to the cove dock and 4 adjacent to the Lakewinds Drive dock.

Section VII -Mooring Hardware: Mooring Hardware Placement and Mooring Markings

A. Hardware Standards and Installation. The Cluster Board is solely responsible for setting the mooring hardware standards for all mooring spaces; determining the mooring markings; contracting for the painting of the markings, the installation of hardware; and any other such detail associated with setting standards as may arise. Any additional installation of hardware is prohibited and will be removed.

B. Hardware and Securing Devices. The mooring space hardware, eye plates with rings, will be installed at each mooring location and on the canoe rack. Locks and other securing cables or devices are the responsibility of the mooring space renter.

Section VIII -Reserved Rights

The Cluster Board reserves the right to modify, add, or delete provisions to this policy or to cancel this policy at any time.
